Distance Sales Agreement

SELLER

BUYER: The natural or legal person who purchases the service and declares their details during order/payment (the “BUYER”).

The subject of this agreement is the sale and performance of the software subscription service ordered electronically by the BUYER through the OtelCiro website (hotel management/PMS, revenue management and digital marketing software and related services), the nature and price of which are stated below, and the determination of the parties’ rights and obligations under Law No. 6502 and the Regulation on Distance Contracts.

• The type of service (subscription plan), the subscription period (monthly/annual) and the total sale price including VAT are clearly shown on the order/payment screen and in the order summary; the BUYER confirms these details before approving the order.
• Payment is made by credit card or debit card via a virtual POS and/or a payment link, through the infrastructure of the licensed payment institution iyzico (iyzico Ödeme Hizmetleri A.Ş.).
• Card details are never seen or stored by the SELLER; payment data is processed by iyzico in compliance with PCI-DSS standards.
• Prices may be updated for renewal periods provided the SELLER gives prior notice.

The service is digital in nature. After the payment is approved, the BUYER’s account/access is, as a rule, activated immediately and at the latest within 1 (one) business day, and performance of the service begins. For details on delivery and activation, please see the Delivery & Returns page.

The BUYER has the right to withdraw from the contract within 14 (fourteen) days from the date the contract is concluded, without giving any reason and without paying any penalty. It is sufficient to notify the SELLER of the withdrawal within this period.

Beyond this, and in favour of the BUYER, the SELLER applies a subscription policy based on pro-rata refunds: the BUYER may cancel the subscription at any time, and the unused portion of the current billing period is refunded proportionally. The amount to be refunded is returned to the card/payment instrument used for payment within at most 14 (fourteen) days from the date the request reaches the SELLER. The time for the bank to reflect the refund in your account is subject to the bank’s own processes.

• The SELLER is obliged to provide the service in conformity with the contract, continuously and diligently.
• The BUYER is responsible for the accuracy and currency of the information provided during the order.
• The BUYER agrees to use the service in compliance with the law and this agreement.

In any disputes arising from this agreement, the Consumer Arbitration Committees and Consumer Courts at the BUYER’s place of residence or at the place where the service was purchased are competent, within the monetary limits announced annually by the Turkish Ministry of Trade.

By approving the order electronically, the BUYER is deemed to have read, understood and accepted all terms of this agreement; the agreement enters into force at that moment.
